He was fined £1,846, ordered to pay costs of £300 and a victim surcharge of £738, totalling £2,884.

The court heard that Between 20 and 26 February 2026 a fly-tip was discovered at Aust Road, Elberton, which consisted of a number of large black bin bags containing household waste. This location, locally known as the ‘triangle’ has previously been identified as a ‘hot spot’ for fly-tipping. The council’s envirocrime enforcement officers searched the waste and discovered paperwork featuring a name and address in Davies Close, Yate.

On 3 March, officers visited the address and after receiving no response, a calling card was posted through the door. Later that day an email was received in response from Debenham’s partner, who explained that that her husband was going to dispose of the bags, but she was unaware that he had fly-tipped them. She confirmed her husband’s details and a notice requesting that he attend an interview was sent to the address, with an interview arranged for 18 March 2026.

Debenham attended the council’s Yate offices for the interview where he explained that they had missed their household bin collection day and he decided he would dispose of the bags at his workplace, but because they hadn’t left the bins out as usual, the bags remained in his car. He then decided he would dump them in an area he knew on Aust Road in Elberton. He further explained that he was very familiar with the Aust Road area as he had driven these a great deal as part of his commute to work in the past. He also stated that he had lived locally in the surrounding areas of Alveston and Thornbury and knew that the area would be quieter and he would not be seen.

He then planned to take a different route to work one morning, from his address in Yate via Aust Road, and dump the bags on his way. Debenham described that at around 5am on the day of the offence he had driven to the area, parked up and turned off his lights before removing the bags from his vehicle and dumping them at the location. He further stated that this act was done out of desperation and not intentionally, but after it was put to him that he had pre-planned what to do with the rubbish bags, he agreed that this was a premeditated act and that his actions were nothing but intentional.

Councillor John Bradbury, cabinet member responsible for environmental enforcement at South Gloucestershire Council, said: “I’m very pleased to see this case conclude with a considerable fine handed out. This instance was pre-meditated and not carried out on the spur of the moment, with the offender clearly identifying where and how he could illegally deposit waste. South Gloucestershire Council is determined to stamp out fly-tipping and we will be relentless in pursuing people who are responsible for this type of environmental crime. We want to send out a clear message to anyone who dumps waste illegally in South Gloucestershire that they will be prosecuted and brought before the courts.”

During October, South Gloucestershire Council is teaming up with Keep Britain Tidy for ‘Fight Fly-Tipping Fortnight’, a campaign warning residents about criminal waste traders who use convincing, professional-looking online ads to pose as legitimate businesses – only to illegally dump the rubbish they are paid to take away. The social media campaign calls on people in South Gloucestershire to protect themselves and their communities from falling for a #RubbishDeal – low-cost, unlicensed services offered using appealing ads on social media by organised waste criminals. Rogue waste traders hide in plain sight behind professional-looking adverts, ‘five-star’ reviews and tempting prices, making it difficult to tell them apart from legitimate operators. What they don’t tell you is where your rubbish could end up.

Fight Fly-tipping Fortnight is about helping residents know what to look out for and make simple checks before handing over their rubbish to avoid it being illegally dumped on streets, fields and public spaces. The campaign calls on households to take three simple steps to avoid a #RubbishDeal:

Ask for a waste carrier licence

Check the number on the Environment Agency’s public register at https://environment.data.gov.uk/public-register/view/search-waste-carriers-brokers or call 0300 065 3000)

Check you’ll get a receipt.

Councillor Bradbury added: “Fly-tipping takes a real toll on our communities. The council works tirelessly to tackle the problem, but we need local people’s help to stop it at the source. No one wants to think that the person they’ve paid to take away an old sofa, mattress or pile of household rubbish could simply dump it somewhere else in their community. However rogue waste traders are making money from doing exactly that – leaving councils and local residents to deal with the consequences.

“During Fight Fly-Tipping Fortnight, we’re asking our residents to make three simple checks before handing over their rubbish: ask to see a waste carrier licence, check it on the Environment Agency register and get a receipt. It only takes a few minutes and can help protect you, your community and our local environment from fly-tipping.”

Allison Ogden-Newton OBE, Chief Executive Officer at Keep Britain Tidy, said: “Local authorities see first-hand the damage fly-tipping causes, working every day to clear illegally dumped waste and protect the places their communities value. Tackling the problem places huge demands on already stretched council teams, which is why we’re so pleased to have South Gloucestershire Council supporting Fight Fly-tipping Fortnight this year.”

“People hiring someone to take away their rubbish should be able to trust that it will be disposed of responsibly. But rogue waste traders are exploiting that trust, taking people’s money and then leaving their waste dumped in streets, fields and public spaces for communities and councils to deal with.

“What makes this particularly difficult is that criminals can be surprisingly hard to spot. A convincing advert, good reviews and a cheap price can make an illegal operator look like a legitimate business, leaving people thinking they’re paying for their rubbish to be responsibly taken away when it could end up dumped in their own community.

“Our message is simple: don’t fall for a #RubbishDeal. If it looks too good to be true, it probably is.”

Household waste can be taken to the council’s Sort It recycling centres where it can be disposed of at no cost www.southglos.gov.uk/sortitcentres

Residents who see illegal fly-tipping are encouraged to report it by contacting the council’s StreetCare helpdesk on 01454 868000, emailing streetcare@southglos.gov.uk or visiting www.southglos.gov.uk/flytipping

A Yate man has been ordered to pay almost £3,000 after South Gloucestershire Council prosecuted him for fly-tipping black bin bags, which were discovered dumped at Aust Road in Elberton, South Gloucestershire.
